Welcome to Build N Fixit. These Terms of Service ("Terms") govern your use of the website located at buildnfixit.com and all related services operated by Build N Fixit LLC ("Build N Fixit," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Description of Services

Build N Fixit is a contractor matching and referral platform that connects homeowners in the greater Sacramento area with independently licensed home service professionals. Our services are limited to:

• Classifying your home repair or improvement needs based on the information you provide.
• Matching you with qualified, independently licensed contractors in our network.
• Facilitating initial communication between you and the matched contractor.

2. Eligibility

You must be at least 18 years old to use our services. By using our website, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. User Obligations

When using our services, you agree to:

• Provide accurate, current, and complete information in all forms and communications.
• Use our services only for lawful purposes related to home repair, improvement, or maintenance inquiries.
• Not misuse, interfere with, or attempt to disrupt our website or services.
• Not impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Contractor Relationships and Independence

Contractors in our network are independent, licensed professionals. They are not employees, agents, partners, joint venturers, or representatives of Build N Fixit. Build N Fixit does not control, direct, or supervise any contractor's work, methods, scheduling, pricing, or business practices.

Any agreement for home improvement or repair work is entered into directly between you and the contractor. Build N Fixit is not a party to, and has no obligations or liability under, any contract between you and a contractor. Under California law, home improvement contracts over $500 must be in writing and must comply with the requirements of California Business and Professions Code Sections 7159 and 7159.5 — it is the contractor's responsibility to provide you with a compliant written contract.

You acknowledge that any disputes regarding the quality, cost, scope, or timeliness of work performed by a contractor are between you and that contractor. Build N Fixit will not mediate, arbitrate, or otherwise resolve disputes between homeowners and contractors.

6. Contractor Screening and Vetting

We take our vetting process seriously — it's what sets Build N Fixit apart. Before a contractor joins our network, we verify their active California contractor's license, confirm they carry liability insurance, and evaluate their reputation and track record in the Sacramento community. We personally stand behind the professionals we refer.

That said, because each contractor runs their own independent business, we cannot control or guarantee the outcome of every individual job. Licensing and insurance status can change over time, and the quality of any specific project depends on factors unique to that engagement. If you ever have concerns about a contractor's credentials, the California Contractors State License Board (CSLB) at cslb.ca.gov provides real-time license verification.

7. Disclaimer of Warranties

Our website and matching services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Build N Fixit disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that: (a) our website will be uninterrupted, error-free, or free of harmful components; (b) any contractor match will result in a successful engagement; or (c) any contractor in our network will perform work to your satisfaction or in compliance with applicable laws and building codes.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Build N Fixit LLC, its owners, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to damages resulting from contractor work, service delays, property damage, personal injury, or loss of data.

Our total aggregate liability for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid to Build N Fixit, if any, in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability for fraud, intentional misconduct, willful injury, or any other liability that cannot be excluded or limited under California law, including California Civil Code Section 1668.

9. Indemnification

You agree to indemnify and hold harmless Build N Fixit LLC and its owners, members, employees, and affiliates from any third-party claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your misuse of our website or services; or (c) information you provide that is false, misleading, or inaccurate. This indemnification does not require you to indemnify Build N Fixit for its own negligence or willful misconduct.

10. Your California Consumer Rights

Nothing in these Terms is intended to waive or limit your rights under the California Consumer Legal Remedies Act (Civil Code Sections 1750 et seq.), California's Unfair Competition Law (Business and Professions Code Section 17200 et seq.), or any other consumer protection statute that cannot be waived by agreement.

11. Dispute Resolution

If you have a dispute with Build N Fixit, we encourage you to contact us first at info@buildnfixit.com so we can attempt to resolve it informally. If we are unable to resolve your dispute informally, any legal action must be brought in the state or federal courts located in Sacramento County, California.

If you have a dispute with a contractor you were connected with through our platform, that dispute is between you and the contractor. You may contact the California Contractors State License Board (CSLB) at cslb.ca.gov to file a complaint against a licensed contractor.

12. Intellectual Property

All content on our website — including text, graphics, logos, and software — is the property of Build N Fixit LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid, unenforceable, or void by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if that is not possible, it shall be severed from these Terms.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
